ASSOCIATION WITH BRADY & O’SHEA, P.C. TO HANDLE IOWA REPRESENTATION OF
BRICAN CLASS MEMBERS
Charlip Law Group, LC is pleased to announce that it has associated
the firm of Brady & O’Shea, P.C. in Cedar Rapids, Iowa to represent the
interests of our clients/putative class members in the defense of cases
filed in Iowa. The Defendant Professional Solutions Financial Services
in the class action litigation instituted in Miami Dade County Circuit
Court has embarked upon a strategy of suing all putative class members
not making their payments in state district court in Polk County Iowa.
Charlip Law Group, LC, with the local assistance and expertise of Brady
& O’Shea, P.C. is seeking to dismiss or stay such suits pending
resolution of the class action.
Brady & O’Shea, P.C. brings years of experience working on leasing
disputes as well as seasoned litigation skills to the aid of our
putative class members. Cedar Rapids, Iowa is home to a fairly large
leasing company. That company has a forum selection clause in its leases
providing jurisdiction in the Iowa Courts and venue in Cedar Rapids.
Because of that, Brady & O’Shea, P.C. has defended approximately 30
cases involving commercial finance leases. About half of those cases
involved motion practice related to jurisdiction or venue. Some reported
examples are
Great America
Leasing Corp. v. Telular Corp. 1999 WL
33656867 (N.D. Iowa 1999) involving a forum dispute. Brady & O’Shea,
P.C. also had significant motion practice on forum selection in another
lease dispute in the Northern District of Iowa Case No. 07-cv-00065,
(available through Pacer - involving fact based arguments and Colorado
River abstention).
Charlip Law Group, LC has modified its Retainer Agreements to include
Brady & O’Shea, P.C. in connection with the defense of cases in Iowa’s
courts. We would ask all of our existing clients to download the new
Retainer Agreement and provide the firm with an executed original of
this revised Agreement so that a proper consent and representation
authorization may be secured for the services of Brady & O’Shea, P.C. No
additional retainer is being requested from any of Charlip Law Group,
LC’s clients and the initial fees and costs of Brady & O’Shea, P.C. will
be paid from existing retainers with monthly bills being rendered in the
same fashion as by Charlip Law Group, LC. The lead attorneys and contact
